  1. Policy Statement

    This policy (the “Privacy Policy”) of Valley Pay LTD Tanzania DBA (Nyumba Fasta) (“NYUMBA FASTA” or “the Company”) explains how it collects, uses, discloses, transmits, and retains their personal information. The terms used in this Privacy Policy have the same meanings as in NYUMBA FASTA’S Terms and Conditions, except where otherwise defined in this Privacy Policy. By continuing to use the Company’s Platform, you hereby agree to be bound by all of the terms and conditions of this Privacy Policy as it is presented to you as of the date of your first use of the Company Platform.
  2. Information You Provide to Us

    When using our service, Nyumba Fasta requires you to provide information to us. Some of this information may be considered Personally Identifiable Information (PII) under applicable State and Federal law. The categories of PII Nyumba Fasta may collect from you include, but are not limited to: • Your full, legal name; • Your email address; • Your telephone number; • Your physical address; • Your payment information (credit card number / Mobile Wallet Account Details) Nyumba Fasta will also require you to create a password or other access code associated with your Nyumba Fasta account, which may be considered PII in certain circumstances. Nyumba Fasta takes the security of its customers’ data seriously and as such will always treat your password or access code as PII. Nyumba Fasta offers certain services through third parties with which it is integrated. These services providers may require you to provide them with additional information in order to facilitate your use of their services. Nyumba Fasta encourages its customers to review the privacy notices of its third-party service providers regarding their treatment of your information.
  3. Use of Personal Information

    Nyumba Fasta uses your personal information in the following ways: 3.1 Meeting Our Legal and Regulatory Obligations To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents. Nyumba Fasta may also disclose your personal information to law enforcement agencies, State regulatory agencies, and Federal agencies in order to comply with our legal and regulatory obligations with respect to these governmental institutions. 3.2 Satisfying our Obligations to You Nyumba Fasta will share your information with third parties in order to complete our obligations to you with regards to services for which you have paid us. These include third parties which facilitate our services, provide services on our behalf, or provide services directly related to the service or product which you have purchased from us. We require our third-party service providers not to disclose your PII for any purpose apart from providing the service or product you have purchased from us. 3.3 Improving our Service Nyumba Fasta may disclose your PII to third parties for the purpose of improving the products and services we offer. These include, but are not limited to, third parties which conduct analytics services on our behalf, and independent auditors. Nyumba Fasta requires that any third parties engaged with Nyumba Fasta in this capacity are required to not disclose any personal information. 3.4 Marketing Nyumba Fasta does not use your PII in its marketing campaigns to people who are not customers of Nyumba Fasta. Nyumba Fasta may use your PII on an internal basis in order to develop and tune its external marketing campaigns. Nyumba Fasta will communicate electronically with you, on a periodic basis, regarding offers associated with its products and services. Nyumba Fasta does not directly offer unaffiliated services to its customers. Nyumba Fasta’s marketing to you complies with applicable U.S. digital marketing requirements. We will always disclose that we are communicating and marketing services to you. We will always offer you an option to “opt-out” or otherwise unsubscribe from our marketing communications. If you do not wish for your PII to be used in marketing efforts, or if you wish to no longer receive marketing communications from Nyumba Fasta, please refer to Section 7.0 of this Privacy Policy for how you can get in touch with us.
  4. Children’s Online Privacy Protection Act Policy

    The Children’s Online Privacy Protection Act (COPPA) was enacted in 1998 for the specific purpose of protecting children’s use of the internet and to assure that children under the age of the 13 do not share their personal information without their parents’ express approval. COPPA requires the operators of websites to establish controls so that parental consent is obtained and documented prior to the collection pf personal information for children under the age of 13. Nyumba Fasta does not market to children under the age of 13. Nyumba Fasta requires that an individual be 18 years of age or older before we will offer our services to them. If Nyumba Fasta detects any instance where it has obtained the PII of a child under the age of 13, Nyumba Fasta confirms that it will immediately destroy that information.
  5. Cookies

    Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. Nyumba Fasta’s services do not explicitly use “cookies”. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service. Some browsers have a “DO NOT TRACK” feature that lets website users inform websites or other applications that they do not want to have their online activities tracked. These “do not track” features may also give website users other choices regarding the collection of their personal identifiable information. However, these “do not track” features and “do not track’ signals are not yet uniform. ACCORDINGLY, EACH USER OF THE PLATFORM IS HEREBY NOTIFIED THAT THE PLATFORM IS NOT CURRENTLY SET UP TO RESPOND TO ANY OF THE USER’S “DO NOT TRACK” FEATURES OR “DO NOT TRACK” SIGNALS.
  6. Retention of Information

    Nyumba Fasta will retain your information for a period of up to five (5) years from the last interaction you have had with us. A “last interaction” means either the date which you last communicated with us (either through phone or email/online support) or the date of your last transaction with us. After this time period has elapsed, Nyumba Fasta will destroy your information in compliance with applicable legal requirements.
